INDEMNIFICATION

The User understands that is a tool that is intended to help the user to develop basic wellbeing habits.   It is not intended, nor does it promise to be a replacement for specific spiritual, physical, or emotional therapies or treatments.

Thereby the user agrees to defend and hold, the YMCA of Greater Cincinnati (hereafter “Company”), its directors, officers, employees, agents, affiliates, and partner YMCAs (collectively, “Company Parties”) harmless from and against any and all claims, damages, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to: (i) the User’s use of the Application and its services; (ii) any prayer requests made by the User; or (iii) the User’s breach of this Agreement.

The User acknowledges and agrees that prayer requests or other posts will be public and that if prayers or other posts reveal evidence of illegal activities, risk of self-harm, or other actions potentially leading to legal or actionable issues may result in the company reporting them to appropriate authorities as mandated by law.

Furthermore, the User acknowledges and agrees that there is no guarantee, representation, or warranty that any prayer made through the Application will be answered or result in a specific outcome. The User shall not hold the Company Parties responsible for any perceived failure or ineffectiveness of any prayer request.

This hold harmless and indemnification obligation will survive the termination or expiration of the User’s account and this Agreement.
